A dead cooperating witness now gives Lil Durk fresh ammunition in his fight to save his August 20 federal trial date. (117 chars)
Lil Durk’s federal case lost a key cooperating witness last year, and his lawyers now say that death changes everything.
Court papers say the man died in October, months after prosecutors leaned on his statements to build their case.
Prosecutors refer to him only as Co-Conspirator 6 in their filings. They say he’s linked to a 2019 Atlanta shooting, a 2021 attack near Blackshear, Georgia, and an alleged car theft ring.
One government witness claims personal knowledge of the Atlanta shooting, but that claim rests almost entirely on what Co-Conspirator 6 told him after the fact.
He died before Durk’s lawyers could ever question him directly.
Lil Durk, born Durk Banks, says the death now works in his favor. His lawyers argue they can no longer challenge the account and that this alone constitutes real damage to his defense under the law.
Durk has sat in federal custody since October 2024, when agents accused him of orchestrating a Los Angeles killing meant for Quando Rondo.
His trial date has already been moved four times, most recently to August 20. A new racketeering count filed last month folded the Atlanta and Chicago incidents into that same case.
Durk’s lawyers argue that prosecutors bear the burden of proving they moved quickly enough on the new charges.
If a judge finds that the government dragged its feet, the court presumes harm to the defense without further proof. That standard makes the dead witness even more significant heading into Tuesday’s hearing.
Prosecutors are fighting to keep all the charges in a single trial, arguing that witnesses shouldn’t have to testify twice.
