EXCLUSIVE: Lil Durk Catches Feds Sneaking Banned Evidence Back Into Trial

Lil Durk’s lawyers say the feds tried to sneak in gang photos and drug texts after a judge already ruled that evidence out.

Lil Durk and his legal team caught the government trying to sneak evidence back into a trial it had already been told to keep out.

The defense filed a motion Monday in limine to block a set of exhibits that prosecutors quietly added to their trial list on July 23, without going through the proper legal channels required to introduce them.

The items include photos and texts referencing drugs, guns not connected to the charges, and what the motion calls evidence of “other violence” involving people who aren’t even defendants.

The motion specifically flags a text chat about marijuana sales in January 2023 between two people not charged in this case. Another is a group text that appears to discuss an armed robbery from September 2020.

Durk’s attorneys say prosecutors didn’t bother to give proper notice under federal rules, which require the government to tell the defense what other-act evidence it plans to use and to explain exactly why it’s relevant. They didn’t do that here.

What makes this filing land differently is the context. Judge Michael Fitzgerald already ruled in February 2026 on what evidence the government could and couldn’t bring into this trial. That order should’ve been the end of it.

Instead, prosecutors served a proposed exhibit list in July that, according to Durk’s lawyers, goes well beyond what the court authorized.

The defense put it plainly: the government is trying to use gang imagery, drug texts, and unrelated violence to inflame a jury rather than prove the charges actually on the table.

The backstory explains why this escalation is significant.

Lil Durk, whose legal name is Durk Banks, has been locked up since October 2024 on charges that he orchestrated a murder-for-hire targeting rapper Quando Rondo. The motive, prosecutors say, was retaliation for the 2020 death of King Von, Durk’s close friend and OTF affiliate.

The August 2022 attack happened outside a Beverly Hills gas station and missed Rondo entirely, but killed his cousin Lul Pab instead. The core charges in the August 20 trial are conspiracy to commit murder-for-hire, use of interstate commerce to carry out the plot, and discharging a machine gun during a violent crime.

Then in June 2026, prosecutors filed a third superseding indictment adding racketeering murder counts tied to a separate January 2022 killing in Chicago.

Judge Fitzgerald severed those charges on July 14, ruling they’d be handled in a separate trial. Now the defense says the government is trying to drag that same Chicago-based gang evidence back in through the side door, disguised as exhibits that were never properly noticed and don’t prove anything relevant to the Los Angeles charges.

According to AllHipHop’s previous coverage, prosecutors have pushed throughout this case to frame OTF as a criminal enterprise, a theory the defense has consistently rejected.

Durk’s team didn’t hold back in the filing, accusing the government of trying to turn the trial into a sideshow built on racial bias, writing that the proposed exhibits were “clearly designed to inflame the unconscious biases of the jury.”

The hearing on these motions is set for August 13, one week before trial begins.
