Tenisha Warner sues her late husband’s mother over a prenup he never honored, seeking more than $1.2M from the family trust.
Malcolm-Jamal Warner wasn’t even in the ground a year before the legal battles started. On the one-year anniversary of the actor’s drowning death, his widow filed a lawsuit against his mother in a DeKalb County court, claiming he never lived up to the terms of their prenuptial agreement.
Tenisha Warner, 48, took Warner’s mother, Pamela, to court Monday, according to the Atlanta Journal-Constitution, naming her as successor trustee of the Warner Family Trust the Cosby Show star set up in 1996.
The lawsuit seeks more than $1.2 million from that trust, with Tenisha arguing she’s owed the money as a creditor of his estate because her husband failed to honor the premarital agreement they signed before their marriage.
The prenup laid out a detailed set of financial commitments Warner was supposed to fulfill. He agreed to take out a $1 million life insurance policy naming Tenisha as sole beneficiary, along with a matching policy on her life.

He also committed to paying her $5,000 a month as his “chief of staff,” handing her $16,000 every anniversary, funding a tax-free retirement account in her name, and maintaining college funds for their children.
Tenisha claims none of those obligations were met before he died.
Warner drowned during a family vacation in Costa Rica on July 20, 2025, after getting caught in a strong current while in the water near Playa Cocles.
Costa Rican authorities confirmed his cause of death as accidental asphyxia by submersion. He was 54 years old. AllHipHop covered the confirmation of his cause of death and Bill Cosby’s reaction at the time.
The timing of the lawsuit carries obvious weight, and Tenisha filed on the exact anniversary of his death.
The complaint also seeks to freeze the trust, asking the court to block Pamela Warner from distributing any trust assets while the case is pending. Tenisha simultaneously filed a creditor’s claim in DeKalb County Probate Court seeking the same $1,276,042 plus interest and legal fees.
Court documents show Warner’s estate is currently unrepresented and likely can’t cover what he owed her on its own.
At the time the agreement was signed, Warner was pulling in an estimated $680,000 a year and had a net worth of roughly $3.4 million.
Tenisha, then a graduate student pursuing a doctorate in clinical psychology, had a net worth of zero. The filing notes the couple had been living together at Warner’s properties in Atlanta and Los Angeles and already had a daughter together by the time they signed.
Pamela Warner, who lives in California, couldn’t be reached for comment Monday, and Tenisha’s attorneys didn’t respond to press inquiries either.
Tenisha went public with her identity in September 2025, months after Warner’s death, sharing a wedding photo and launching the Warner Family Foundation in his honor.
