Eminem’s legal team filed an appeal after losing his Australian trademark battle with Swim Shady, refusing to accept the court’s decision.
Eminem just filed an appeal in Australia after losing his trademark battle against a beach brand that’s been living rent-free in his legal team’s head.
The rapper’s lawyers submitted documents to the Federal Court of Australia’s Victoria Registry on July 23, 2026, challenging the Australian Registrar of Trade Marks’ decision favoring Swim Shady, the swimwear company founded in 2024 by Jeremy Scott and Elizabeth Afrakoff.
This move keeps the fight alive, even though the initial ruling stripped his “Shady” and “Shady Limited” trademarks of protection for clothing and merchandise categories in Australia.

Eminem has owned those trademarks since 2002, but the judge found he never actually used them directly in Australia during the three-year period that mattered for the case.
The court wasn’t convinced he maintained sufficient control over his image or business operations down under, which is why he’s now footing the legal bill for Swim Shady’s defense.
Jeremy Scott, the brand’s co-founder, said at the time: “Elizabeth and I are delighted with today’s decision. While this is an important milestone for Swim Shady, it is one step in the broader trade mark proceedings, and we recognize there are still matters to be resolved.”
The timing is wild because Eminem didn’t file for trademark protection for “Slim Shady” in Australia until January 2025, a full month after Swim Shady launched.
According to SBS News, the judge saw this as a reactive move rather than evidence of long-standing brand control.
What makes this story even more telling is that Eminem’s currently fighting Real Housewives of Potomac stars Robyn Dixon and Gizelle Bryant over their “Reasonably Shady” podcast trademark, a battle that’s dragging into 2027.
This pattern shows the rapper’s willingness to pursue anyone using variations of “Shady” for commercial purposes, whether it’s a swimwear line or a podcast brand.
He’s treating the word like it’s his personal property, and he’s not backing down when courts tell him otherwise.
The appeal means this Australian fight isn’t over yet, and Eminem’s also challenging Swim Shady trademark applications in the United States, United Kingdom, and Japan.
