Eminem loses his trademark battle with an Australian beach brand, gets ordered to pay their legal costs, and has until July 22 to appeal.
Eminem lost a trademark battle in Australia that he probably didn’t see coming, and the consequences are real.
On July 1, trademark adjudicator Benjamin Goldsworthy ruled that the rapper’s decades-old “Shady” trademarks won’t protect him from a Sydney beach brand called Swim Shady, which means the company can keep selling its umbrellas, towels, and swim bags without legal interference.
The decision essentially narrowed Eminem’s trademark protection to exclude clothing and merchandise categories, leaving a massive gap in his brand defense strategy.
Eminem held trademarks on “Shady” and “Shady Limited” in Australia since 2002, but Goldsworthy found that he never actually used those marks on clothing, bags, footwear, or related merchandise during the relevant period.
The evidence showed only three customer purchases of Eminem merchandise in Australia for the entire timeframe being examined. That’s not a business presence. That’s barely a footprint.
The adjudicator specifically noted that Eminem didn’t exercise actual control over merchandise sales in Australia, which became the fatal flaw in his legal position.
Swim Shady founders Jeremy Scott and Elizabeth Afrakoff launched their company in December 2024, selling beach-focused products unrelated to Hip-Hop culture.
They weren’t trying to capitalize on Eminem’s brand. They were just two entrepreneurs with a beach umbrella idea that happened to use a name that rhymed with his famous alter ego.
fScott and Afrakoff released a statement saying, “Elizabeth and I are delighted with today’s decision. We’re grateful for the careful consideration the Delegate has given to the evidence and are extremely pleased with the outcome.”
Eminem’s legal team has been ordered to cover Swim Shady’s legal costs, and he’s got until July 22 to file an appeal if he wants to keep fighting.
Meanwhile, Eminem remains locked in a separate trademark dispute with Real Housewives of Potomac stars Robyn Dixon and Gizelle Bryant over their “Reasonably Shady” podcast, a case that’s stretching into 2027 with no end in sight.
The rapper’s got a decision to make about whether this Australian loss is worth appealing or if he should focus his legal resources elsewhere.
